La proc©dure suivante doit ƒÂªtre suivie par les r©sidents du Qu©bec :

Toutes les plaintes doivent ƒÂªtre trait©es avec diligence.

  1. R©ception d’une plainte

L’agent doit fournir des instructions sur la maniƒÂ¨re de d©poser une plainte sur son site Web, mais le plaignant n’est pas tenu de suivre cette proc©dure. Une plainte peut ƒÂªtre reƒÂ§ue par t©l©phone, courriel, courrier, clavardage, portail en ligne, t©l©copie ou ƒÂªtre publi©e sur les r©seaux sociaux (Twitter, Facebook, etc.).

L’Agent doit accuser r©ception d’une plainte par ©crit. L’accus© de r©ception doit comporter les informations suivantes :

  • le code d’identification du dossier de plainte;
  • la date ƒÂ  laquelle la plainte a ©t© reƒÂ§ue par l’agent, ou par l’interm©diaire financier si cette date ne correspond pas ƒÂ  la date ƒÂ  laquelle la plainte a ©t© enregistr©e;
  • les moyens par lesquels le plaignant peut obtenir des renseignements concernant le traitement de sa plainte;
  • le d©lai pr©vu pour le traitement de la plainte et la date avant laquelle la r©ponse finale doit ƒÂªtre communiqu©e au plaignant; et
  • un lien hypertexte permettant d’acc©der au r©sum© de la politique de traitement des plaintes et de r©solution des litiges, ou une copie de ce r©sum©.
  1. Inscription de la plainte dans le registre des plaintes

L’agent doit cr©er un dossier de plainte conform©ment ƒÂ  la section DOSSIERS DE PLAINTES ET REGISTRE DES PLAINTES ci-dessous.

Toutes les informations requises dans la section DOSSIERS DE PLAINTES ET REGISTRE DE PLAINTES doivent ƒÂªtre incluses.

Le dossier de plainte doit ƒÂªtre cr©© le jour mƒÂªme de la r©ception de la plainte ou dƒÂ¨s que cela est raisonnablement possible.

La plainte doit ƒÂªtre enregistr©e dans le registre des plaintes le jour mƒÂªme de sa r©ception ou dƒÂ¨s que cela est raisonnablement possible.

  1. Analyse de la plainte

Si la plainte concerne l’assureur, l’agent doit en aviser le plaignant et lui expliquer en quoi la plainte met en cause ces institutions, interm©diaires ou agents, l’informer de son droit de d©poser une plainte contre ces institutions, interm©diaires ou agents, et lui fournir toute information en sa possession, le cas ©ch©ant, qui permettrait au plaignant de communiquer avec ces derniers.

L’agent doit fournir un avis de la plainte ƒÂ  Teachers Life.

Toutes ces ©tapes doivent ƒÂªtre r©alis©es ƒÂ  la date de r©ception de la plainte.

  1. R©ponse ©crite ƒÂ  la plainte

Dans les 60 jours suivant la date de r©ception de la plainte, l’agent doit envoyer une r©ponse ©crite ƒÂ  la plainte.

La r©ponse ©crite doit ƒÂªtre soit une « r©ponse finale » telle que d©crite ci-dessous. La r©ponse ©crite ƒÂ  la plainte doit ƒÂªtre incluse dans le dossier de plainte et la date ƒÂ  laquelle elle a ©t© envoy©e doit ƒÂªtre inscrite dans le registre des plaintes. La r©ponse ©crite doit comporter :

  • La r©ponse finale doit faire apparaƒÂ®tre clairement dans une d©claration qu’il s’agit d’une r©ponse finale.
  • La r©ponse finale doit inclure un r©sum© de la plainte reƒÂ§ue.
  • La r©ponse finale doit inclure les conclusions de l’analyse et leurs justifications, ainsi que l’issue de la proc©dure de plainte.
  • La r©ponse finale doit inclure une mention du droit du plaignant de demander ƒÂ  ce que le dossier de la plainte soit examin© par un organisme de r©gulation.
  • Si la r©ponse finale comprend une offre d’indemnisation ou requiert l’acceptation ou la signature du plaignant, elle doit ©galement indiquer clairement le d©lai dont le plaignant dispose pour d©cider d’accepter ou non l’offre, y compris la date et l’heure auxquelles il ne lui sera plus possible d’accepter l’offre.

L’agent doit accorder au plaignant un d©lai raisonnable pour lui permettre d’©valuer l’offre et d’y r©pondre.

 

Quebec

For Quebec residents, the following process must be followed:

All complaints must be processed diligently.

  1. Receipt of a Complaint

The Agent must provide instructions on how to make a complaint on its website, but a complainant need not follow that process. A complaint may be received via phone, email, mail, chat, online portal, facsimile or appear on social media (Twitter, Facebook etc.).

The Agent must acknowledgement of receipt of a complaint in writing. Acknowledgement of receipt must include the following information:

  • the complaint record identification code;
  • the date on which the complaint was received by the Agent, or the financial intermediary if different than the date on which the complaint was registered;
  • the means by which the complainant may obtain information about the processing of the complaint;
  • the expected timeframe for processing the complaint and the date before which the final response must be provided to the complainant; and
  • a hypertext link providing access to the summary of the complaint processing and dispute resolution policy, or a copy of such summary.
  1. Enter the Complaint in the Complaints Register

The Agent must create a complaint record in accordance with the COMPLAINT RECORDS AND COMPLAINTS REGISTER section below.

All of the information required under the COMPLAINT RECORDS AND COMPLAINTS REGISTER section is necessary to include.

The Complaint Record should be created the same day the complaint is received, or as soon as is reasonably practicable.

The Complaint should be logged in the Complaints Register the same day it is received, or as soon as reasonably practicable.

  1. Analysis of Complaint

If the Complaint involves the Insurer, the Agent must notify the complainant, explaining the extent to which the complaint involves such institutions, intermediaries or agents and inform the complainant of the complainant’s right to file a complaint in respect of those institutions, intermediaries or agents and provide the complainant with any information held by it, if any, that would allow the complainant to communicate with them.

The Agent must provide notice of the complaint to Teachers Life.

All of these steps should be completed on the date of receipt of the complaint.

  1. Written response to the Complaint

No latter than 60 days from the date the complaint was received, the Agent must sent a written response to the complaint.

The written response must either be a “final response” as described below. The Written Response to the Complaint must be included in the Complaint Record and the date it was sent must be recorded in the Complaints Register. The written response must provide:

  • The final response must clearly indicate in a statement that it is a final response.
  • The final response must include a summary of the complaint received.
  • The final response must include the conclusion of the analysis, as well as the reasons for that conclusion, and the outcome of the complaint process.
  • The final response must include a statement of the complainant’s right to request to have the complaint record examined by a regulator.
  • If the final response includes an offer to pay compensation or requires the complainant’s acceptance or signature, the final response must also clearly state how long the complainant has to decide whether to accept the offer, including the date and time the offer will no longer be open for acceptance.

The Agent must give the complainant a reasonable amount of time to assess and respond to the offer.
